The New Jersey Department of Environmental Protection (NJDEP) recently announced potentially significant changes to the Remedial Action Permit (RAP) process as a result of amendments to N.J.A.C. 7:26B, C, E, and F.
In furtherance of these changes, NJDEP posted six new forms and instructions to its website, including the following:
- New RAP Initial/New Media Component Application-Soil, Ground Water, and Indoor Air
- New RAP Technical Modification Application-Soil, Ground Water, and Indoor Air
- New Administrative Changes Application
- Revised Contact Information Change Form
- New RAP Application to Administratively Combine RAPs
- New RAP Termination/Removal of a Media Component Application
The amendments also established a new institutional control called an “Indoor Air Notification Area,” which is designed to address indoor air and vapor intrusion exposure pathways. See N.J.A.C. 7:26C-7.5; N.J.A.C. 7:26E-5.7. These regulatory measures are intended to notify the public that air inside a structure is above applicable remediation standards and requires mitigation. Indoor Air Notification Areas (IANAs) must be included in remedial action report submissions. NJDEP has created a new webpage to provide additional information about the IANA regulations and requirements.
Information about Indoor Air Notification Areas must be submitted in a GIS format to facilitate public notification about IANAs. More information about those submission requirements is available here.
